Agreement
FORCE MAJEURE. Neither Participant nor Requester shall be liable for failure to appear or perform its obligations under this agreement in the event that such failure is caused by or due to the acts or regulations of public authorities, labor difficulties, civil tumult, inclement weather, strike, epidemic, interruption or delay of transportation service, or any other legitimate cause beyond the control of Participant and Requester.
SICKNESS AND ACCIDENTS. Participant’s agreement to participate is subject to proven detention by sickness or accident. In the event of such non-participant, the deposit payment (if any) advanced to the participant shall be returned promptly.
PROMOTION AND PRODUCTION. Requester shall be responsible for all matters pertaining to the promotion and production of the scheduled engagement, including but not limited to venue rentals, security, and advertising.
Requester agrees to promote the scheduled participant(s) and will use its best efforts to obtain calendar listings, feature articles, interviews of participant, reviews of the participants and participants recordings in all local prints, radio, and television media.
Participant agrees that Requester may use Participants name, pictures, photographs, recordings, and other likenesses in
connection with advertising and publicizing the engagement(s) hereunder.
INDEPENDENT CONTRACTORS. Participant acknowledges that it is an independent contractor and not an employee of the Requester and shall be responsible for all taxes.
Requester shall control the times and division
of the participation, and Participant shall control the manner, means, and details of such participation.
REPRESENTATIVE’S AUTHORITY TO CONTRACT. By signing this document, the representative and/or agent of the Participant hereby represent that such person is duly authorized and that the Participant agrees to be bound by
the provisions of this Agreement. It is expressly understood and agreed that in acting hereunder solely in the capacity of representative or agent of Participant, said person is not a party to this contract and shall not be liable or
responsible in any way for the omissions of Participant, nor for any failure by Participant to adequately participate or comply with any term or condition hereof.
WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
PERMISSION AND RELEASE - READ CAREFULLY BEFORE SIGNING:
Realizing that there are risks inherent in any Best Of Student Shooters B.O.S.S. Youth League Fund Inc. program(s), and in consideration of this event Best Of Student Shooters B.O.S.S. Youth League Fund Inc.program(s), I/we agree to assume all risks (whether known or unknown) of participation in Best Of Student Shooters B.O.S.S. Youth League Fund Inc. program(s),
to release and hold harmless BEST OF STUDENT SHOOTERS B.O.S.S. YOUTH LEAGUE FUND INC., together with its faculty, staff, employees, coaches, volunteers, trustees and other agents (collectively, the Releasees), from any and all claims, liabilities and damages relating
to any injury, sickness, death or destruction of any property which may arise out of, result from or be in any way connected with the participation of myself/ my child/ward in Best Of Student Shooters B.O.S.S. Youth League Fund Inc. program(s), including transportation to/from related events or activities, other than claims, liabilities or damages based on the gross negligence of Best Of Student Shooters B.O.S.S. Youth League Fund Inc. or its employees. In addition,
I understand that Best Of Student Shooters B.O.S.S. Youth League Fund Inc. program(s), which may include practices, contests,
competitions and/or related activities, may take place away from the main site of Best Of Student Shooters B.O.S.S. Youth League Fund Inc. Headquarters or prearranged facility. When program transportation is not available, I am responsible for either providing that transportation, allowing my child to
transport himself/herself to these activities, and/or allowing him/her to ride with another student or parent.
In signing, or checking yes to this release, I acknowledge and represent that I have read
the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily; no oral representations,
statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18)
years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by the same.

GENERAL: Nothing contained in this Agreement or the accompanying Rider shall be deemed to constitute either Purchaser or Artist a partner or employee of the other party. This Agreement and the accompanying Rider and exhibits express the complete understanding of the parties and may not be amended except in a written communication signed by both parties. If a court finds any provision of this Agreement or the accompanying rider invalid or unenforceable, the remainder of this Agreement shall be interpreted so as best to effect the intent of the parties. This Agreement shall be governed by and interpreted in accordance with the laws of Alabama. In the event of any dispute arising from or related to this Agreement, the prevailing party shall be entitled to attorney's fees.
