Dear Employer,

We thank you for taking the time to spend a few minutes with us to discuss your needs. We will work diligently to identify, select, and present only the most competent candidates that meet the job specifications as outlined to us. ClassATransport.com, LLC will refer candidates without regard to race, gender, color, sex, age, natural origin, physical handicap, disability,
or medical condition.

Fee and Replacement Guarantee Agreement

Our Fee:

1. Our fee is 15% of the candidate’s first-year annual compensation. If the position is hourly, the fee is calculated based on the hourly rate multiplied by 2,080 hours.
2. Our fee is earned when an offer of employment is accepted by the candidate.
3. Our fee is due upon receipt of the invoice.
4. Our fee is due from your company in the event a candidate referred by us is hired or retained in any capacity (including consulting) by your company or any affiliate, or in the event you refer the candidate to another employer who hires the candidate.

The 30-day guarantee period does not take effect until the candidate has STARTED employment:

5. We guarantee the candidate for a period of 30 days.
6. We will replace a candidate that resigns or is terminated for poor performance during the guarantee period.
7. We will replace a candidate for the same position only.
8. We will not charge a fee for the replacement candidate.
9. This guarantee is void if the candidate has commenced employment and the fee has not been paid on time.
10. This guarantee is void if you fail to give us written notification of separation within 5 days of the employee’s resignation or termination.
11. There is not a money back guarantee on candidates that have commenced employment.

Dispute Resolution:

12. You agree that any dispute arising out of the terms of this Agreement shall be resolved in the venue of Los Angeles, California.
13. The prevailing party in any action arising out of the terms of this Agreement shall be entitled to an award of reasonable attorney's fees and costs.
